APPENDIX 11

DISCIPLINARY OFFICER - TERMS OF REFERENCE

 The Disciplinary Officer is authorised to:

a.      Exercise the powers delegated to him in the Disciplinary Regulations;
b.      Brief the media direct on all disciplinary matters;
c.      Sign letters on behalf of the RFU on disciplinary matters;
d.      Investigate, or direct others to investigate, alleged breaches of RFU Rule 5.12, except in relation to Council Members in which case he must first obtain authority from at least two of the “three wise men” elected by Council each year before commencing any investigation;
e.      Sit, or appoint others to sit, as the final appeal of any decision by  a Member or league organising committees including PRL, FDR and NCA ;
f.       Sit, or appoint others to sit, as the final appeal of any decision of the Ticket Sub Committee of the Management Board;
g.      Undertake disciplinary work for the iRB, the Six Nations Committee and European Rugby Cup;
h.      Resolve, hear and adjudicate on such matters as the Council, the Chief Executive of the RFU or the Management Board may refer to adjudication;
i.       Report to the Governance Standing Committee and the Council on current disciplinary matters and trends and through these bodies make recommendations to improve disciplinary standards and procedures throughout the game; and
j.        Undertake any other disciplinary related tasks delegated to him by the Council.
